"Courts would enforce mandatory arbitration provisions, and that would put the outcome into the hands of an association that is formed for the purposes of ensuring enforcement our commitments to commons-based models. It's like creating a shadow court system for the commons, one that is legally protected by our primary court system, but which is far easier (and cheaper) to access and use (a la Elinor Ostrom's principle that we need readily accessible conflict resolution mechanisms)."
